Paternity cases are any case in which the parents of a child are NOT married.  Once an Adjudication is Ordered, the Department is also responsible for the sending forms to the Division of Vital Statistics.

No: Name of Form Instructions
CJ-D 106 Paternity Complaint - Revised August, 2009 You must file a separate complaint for each child.  Complaint for establishment of paternity, support and custody of minor children.  To be filed in cases where the parents of the child are not married to each other.  This form must be printed on bonded, acid free paper.
CJ-D 109 Complaint for Support, Custody and Visitation Revised August, 2009 This is to be filed on cases where paternity has been established, and the parents of the child are not married to each other.  You must file one complaint for each child.  This should be printed on bonded, acid free paper.
Complaint to Establish Paternity - In Equity Form to use by Biological Father when mother was married at time of child's birth and her husband was named father on Birth Certificate.  This form must be printed on bonded, acid free paper and the second page MUST be printed on the back of the first page.  Refer to M.G.L. C. 215 Sec. 6.
Statement of Information Required for Amendment of Birth Record Form must be printed on bonded, acid free paper.
Affidavit of Nonpaternity You should print the second page on the back of the first page and use bonded, acid free paper.
Affidavit of Filing Certified Copy of Child Custody Judgment Must be printed on bonded, acid free paper.
Motion to Release Birth Certificate

(Must be accompanied by an Affidavit in Support of this motion)

If you file this motion, you MUST also file an Affidavit in Support of said motion. Motion MUST be printed on bonded, acid-free paper.
Affidavit in Support of Motion to Release Birth Certificate Must be filed with the Motion to Release Birth Certificate
OCAJ-1 TCR IV Affidavit Disclosing Care and Custody Procedure Must be filed with all petitions/complaints wherein custody is an issue

CJ-D 301S Financial Statement Short Form - Revised July, 2007 Financial Statements must be filed in all cases where money is an issue.  Please use this form if your income is under $75,000 per year.  (Go to specialized forms if your income is over $75,000) This MUST be printed on bonded, acid free paper.
CJ-D 301L Long Form Financial Statement Revised July, 2007 Financial Statements must be filed in all cases where money is an issue.  Please use this form if your income is over $75,000 per year.  (Go to general  forms if your income is under $75,000) This MUST be printed on bonded, acid free paper.
CJ-D301 Schedule A Schedule A Revised July, 2007 To be completed in addition to Financial Statement if you receive self-employment or business income. Please use bonded, acid free paper
